This is a written statement you sign in front of a Notary (for minor errors) or a Magistrate (for major errors) to declare what the correct details are. ⚠️ **Most Common Mistake: Using the wrong type of affidavit.** A Notary affidavit is enough for spelling fixes, but for wrong date of birth or completely different parent's name, the Municipal Corporation will reject a Notary affidavit and demand a Magistrate's affidavit. Always check with the issuing office what type they accept before spending money on the wrong affidavit.

Submitting the Affidavit for Correction

Once your affidavit is ready, submit it along with:

at the same office that issued the birth certificate (Municipal Corporation / Gram Panchayat).

Important Tips

  1. Do not sign the affidavit at home. Notarisation requires you to sign in front of the Notary / Magistrate.
  2. Match your details with supporting documents. If your affidavit says one name but your Aadhaar says another, you may need a second affidavit to bridge them.
  3. Keep your supporting documents original. The Magistrate may want to see the school TC and hospital records in person.
  4. Use the exact spelling. The corrected name in your affidavit must match exactly what you want on the corrected birth certificate.
  5. Family members may need separate affidavits. If a parent’s name is being corrected, the parent themselves should also sign an affidavit confirming the correct spelling.

Common Questions

Do I need a Notary affidavit or a Magistrate affidavit for my correction?
For minor spelling errors (e.g., 'Pooja' instead of 'Puja'), a Notary affidavit on ₹100 stamp paper is sufficient. For major corrections like wrong date of birth, completely different parent's name, or wrong sex — most Municipal Corporations require an affidavit from a First Class Judicial Magistrate (JMFC). Ask the issuing office before getting the affidavit.
Who should sign the affidavit — the person whose certificate it is, or the parent?
If the person is a minor (under 18), the parent or legal guardian signs. If the person is an adult, they sign themselves. For deceased persons, a legal heir can sign with proof of relationship.
What denomination of stamp paper is needed?
₹100 stamp paper is the most common requirement for minor corrections. Some districts ask for ₹200 or ₹500. For magistrate affidavits, ₹500 stamp paper is standard. Ask your local notary or stationery shop near the court complex.
My birth certificate has a wrong spelling that has carried into my Aadhaar. Which document should I correct first?
Always correct the birth certificate first. The birth certificate is the source document. If you correct Aadhaar first, the next office that asks for both will reject due to mismatch. Order of correction: Birth Certificate → School TC → Aadhaar → Other documents.
Can I type the affidavit on plain paper instead of stamp paper?
No. The affidavit must be printed on legal stamp paper of the prescribed value (or e-stamp paper). Typing on plain paper makes it invalid for legal purposes. Stamp papers are sold by licensed vendors near courts and tehsildar offices.
